Asked in Muslim Law Law
Dear sir, You have a right over the property. It will be as per Muslim law ( as could understand from your name as your religion is not mentioned in the factual matrix) But factual matrix of your case does not give much details. You must give full details of your family background , whether property is ancestral or not etc when you consult the advocate. Thanks
Dear Sir The matters needs to be discuss in person as Muslim law is complicated subject.
Hi, You legally have a right over the property as much as your other siblings. A well versed advocate would initially make a family tree of who will be the beneficiaries of the succession and then calculate your share accordingly. Definitely, there are a number of factors which are to be taken into consideration which deciding your share, such as your sect and things like the number of brothers your father had. Highly recommend you consult an advocate. Thank you.
My suggestion is to reach out to an advocate who is well-versed in Muslim law as Muslim law of inheritance is quite different from Hindu law of inheritance. In India, Muslim inheritance is covered by personal law unless a will was made. Further, inheritance principles are different for Shias and Sunnis. Therefore, to figure out the best recourse reach out to a local lawyer who knows Muslim personal laws well.
Imran, You must get your rights as per law but first of all you may clear that the whole property purchased by your father or the property belong from Grand father and then it comes to your father's name.- this is one things, Before filling any suit regarding property you may first talk with your brothers either you personally or through your Advocate if they are easily ready to give your share then it's well and good otherwise then you move to Legal Steps.
