Person aggrieved by any action of the bank or financial institution, can approach the DRT. Section*Phone*A of SARFAESI Act, 2002, specifically provides for claim regarding tenancy or leasehold rights wherein Debts Recovery Tribunal can examine such claims.

Dear Sir, Yes, you may approach High Court or DRT for necessary stay orders otherwise Bank being the party having first charge over the property it can get possession of the same or put the property for public auction without your notice and consent. Please give me rank after viewing my details. Please call me for further assistance.

Dear Mr. Vijayaraghavan Kindly tell has the bank taken possession under the SARFAESI Act and are you the tenant in that property? If yes, you would need to file a case before Debts Recovery Tribunal, Chennai. Hope this answers your query. You may get back to me with more details for further suggestions.
