The ancestral property has to be partitioned between the alive legal heirs. The children died premature are not to be considered under Hindu Law. The ancestral property has to be divided in the Legal heirs. Please give me Rank Five and follow me after reviewing my resume and book a consultation for further discussion and explanation if required.

Hi Kiran, If the property is ancestral property, the share would be divided equally among all the alive children, however, it would be further divided if they also have their children. As the ancestral property is always divided equally among all the co-parceners. If you find this helpful, please rate us for the same.
