We understand that our elder most son-in-law (Jamaai) threatened his Father-in-law against writing WILL document. Jamaai threatened both Father-in-law and mother-in-law against the same highlighting few 'Disadvantages' from writing of a will document. "Disadvantages" told : both sons shall neglect you if you write WILL ! We have an evidence in the form of hand delivered letter instructing the same to father-in-law but has no date mentioned on it. This might have been done since my father was hard of hearing. Letter was hand- delivered along with verbal threats. Can son initiate any legal action against his brother-in-law for preventing my father from writing his WILL as per his wishes? BOTH my father and mother had died recently without writing any WILL. This shall fall under civil or criminal offense. Since both parents have expired both sons are facing mountain of difficulties starting with missing keys of Almirah, documents, Jewellery, FD Certificates etc.

Dear sir, After death of the father, all property is to be divided among the legal heirs equally. So absence of will shall not really affect your claim in the property. However, as you are facing issues now, you can file complaint against son in law and also stop him from taking any undue advantage in the property. Besides, it would be advosed that you inform banks about the situation so that they do not grant the assets belonging to your father to anyone else. You should get a legal heir certificate and claim ownership of property. Thank you

- As per law, after the death of your parents intestate , his parents would be devolved upon all the legal heirs equally . - If , your brother in law creating trouble , then you can file a compliant against him , as he not having any share in the left property . - Further , being the legal heir , you can inform the bank to stop any payment from the deceased account without your consent . - You can contact me , if further suggestion needed.

Legally no actions can be taken as Father in law has the independent authority to deal with the matter. But socially the sons forbid the son in law for interfering in the personal and domestic matters.
