We have sold our property in a cooperative society and have gotten the property registered in the new buyers name. Also, we have surrendered the share certificates and resigned as a member of the society. We are facing the following issues: 1. The society is forcing us to pay x amount of money as gratitude or tradition. They are threatening us that they will create problems for the new buyer as committee has not given an NOC to the new buyers, if we do not pay up. 2. As a mutual verbal agreement, the buyer allowed us to stay until the end of the month. Now the buyer is being asked by the society, if we (sellers) have paid rent to them and on what grounds are we continuing to stay in the premises. What options do we have?

they can not claim any amount or force you .this is illigal and you can make a complaint to police.

Hello Sir The society cannot force you to pay any amount of money as gratitude or a tradition. Neither they have any rights to ask on what basis you are staying in the property. It your personal matter with the person who bought the property. You could a send a letter to the society to stop harassing you otherwise you would take legal action against them. There is no requirement for you or your buyer to pay any amount to the Society unless there are specific by laws to that effect. Please ask the Society to show the exact bylaws/ rules forcing which they are claiming such costs. Society have no locus stand to ask buyer for rent from you. Also absolutely no need to pay anything as gratitude. Tel them that even their fathers from hell have to give NoC. by one legal notice from lawyer, all of them will fall on your and lawyer feet.
