Illegal Property Encroachment

It was a rented property and I was receiving rent. A DMK councilor filed a suit in 2011 against me, claiming the property is under his possession and claims ownership with fake documents. The case was dismissed on my favor in 2019. He went for appeal again, I too replied. Last month he illegally encroached the property and took possession. While filing the case the property was under my possession, but he took illegal possession while case is on the court. Police not supporting us. Now do I need to file a separate case in lower court or can I update the issue the upper court itself? What I have to do.
