We have booked from Property Developer a plot and a farmhouse villa to be constructed thereon in one of their Projects in Maharashtra. Payment is fully made for land and farmhouse. Villa. Land allotment letter is issued to us and construction of farmhouse by the Developer is underway. During on-going construction, cyclone Nisarg has caused damage to the roof and ceilings of the under-construction farmhouse villa. Now the Developer is demanding the cost of re-work from us. Is the demand for Developer justified?

Dear Hemendra, In the contact or builder buyer agreement there would be force majeure clause and usually such clauses are invoked so that no delay is accounted for. Therefore I would like to read the terms and conditions entered into. Regards, Kajal Bhatia

What has been mentioned in the recitals of the agreement You had entered with the Developer. Under such situations how to deal with is the basic question? It will be a debatable question otherwise.
