Currently, we want to build one small house for our farming purpose. However, we have filled a partition suite with our uncle. if we build any house on the common plot. will my uncle be able to order stay on this construction? Moreover, my uncle has already constructed 5 small houses and one shed for their cow and ships. some part of which is on common plot and rest is on a plot which they are using within our permission. Please give some legal advice whether we should go ahead with a small house or not.

if you gave permission to uncle doesnt mean he will also allow you. You can also take injunction order and he can also take it to not to make any changes.

Hi, A stay order can be sought from the court to maintain the status quo on the property which is yet to be partitioned. The construction done by your uncle in the common plot or beyond his allotted share would be nullified and the new owner can proceed to enjoy the property as he likes.
