The Courts cannot blindly issue Injunctions/stay in such matters. If there is a safety concern it can be managed by your statement before the court. If there is a matter of tenancy right that can be solved by subrogation etc. But your right to demolish the dangerous structure cannot be stopped. Even the Civic Authorities will have to ask for pulling down such dangerous structures. You may also involve the Civic Authorities in the matter for demolition of the structure.
