Possession Notice By HDFC Bank On Flat/property

1) Borrower who got Possession Notice against his flat/property by HDFC bank under Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 and in exercise of powers conferred on him under Section 13(4) of the said act read with rule 8, after already defaulting on a erstwhile notice served against Borrower to repay the certain amount (Which Borrower has been defaulting) in exercise of powers conferred under section 13(12) of said act read with Rule 3 can sell the said flat/property before getting the no dues from bank or clearing the Possession Notice. 2) If Borrower sells the said flat/property post getting Possession Notice against his flat/property as mentioned in Question no. (1) will land into a fraud/cheating case. If Yes, Which entity can file a lawsuit in such a scenario against the Borrower, is it the Purchaser, Bank or both. 3) In above scenario as per Question (1), can a Purchaser of said flat file a FIR.
