    The co Owner has the right to raise the question. It would be proper to get the matter decided and finalised mutually before reaching out to the Builder.     as the property is joint so it will better to get partition first of all then allowed the construction

    1. since it is a joint property, resultantly, consent of all partners/shareholders is mandatory, 2. two brothers can file a suit for the partition of the property against the third brother, and, after partition can provide the building to the builder

    you should go into mediation through case if your brother not agree than you can file civil case against him
