    The basic information required is the Title of the property Which will define the nomenclature of the property. If it was in the name of Your Father then it would be partitioned between You both the brothers otherwise the non applicant will get share out of the share of father.     If you can prove that the property is totally paid up by your father then under benami property act you can claim 50% share in it by succession otherwise you are entitled to 25% share. i.e half share of your father's half share in the property.

    Dear sir, If the property was registered in your father's and brother's name, then legally he is entitled to the ownership of it. However, if your brother agrees to make a gift deed in your favor and share 50% ownership with you , then you can easily claim your rights over the property. It is advised that you settle the matter with your brother and convince him to do so. Thank you Thank you
