Two brothers equal shared house(2 stories each. House has a common gully which has stairs too. Left side is widow's side and right side is other brother's side). One brother want to sell but another brother's widow do not want to sell. Brother threatening to break shared gully which will cause renter's to vacate the house. Widow is patient of depression and anxiety so we don't want her to go to court and take trouble and risk her health. Question 1. Can we seek help of the court and provide all necessary authorizations to a lawyer so that widow never have to go to court. We want to avoid any anxiety/depression problems to the widow while fighting this case. House registry has both the son's name. Both family has been living in the house from past 20 years. widow's husband died 2 years ago. Widow has a daughter and she is married and has her own family and so she cannot be available to fight the case for her

Hai, Since the property in the question is a commonly owned one, the division of assets can only take place on a voluntary basis if all owners agree to it, with Mutual Consent or with the help of law (filing a suit in court). The partners who have shared ownership in property can file a suit in the appropriate court of law. For the easy process of division, it is must-have ownership papers, transfer papers and all other original documents related to the property. Yes, you can authorize a lawyer to represent you in the case, but the widow have to be present at the court, if the she is required by the court to do so.
