I am planning to buy a property (apartment in a society) in U.P., where the sole owner of that property has passed away, however, he had a will (unregistered) and basis that along with newspaper advertisement, mutution certificate has been granted by the authority. Along with that, a Gram Panchayat Document signed by Sarpanch, confirming the legal heirs has been provided. Plus relinquish deeds from all other legal heirs in the name of one legal heir (Wife of original owner) has also been provided. Now the agreement for sale is signed by this one legal heir (Wife of the original owner) in my name and will be transferring the property to me. So wanted to check if this document trail will suffice for a successful transfer and also I will be able to get bank loan on the property.

Hello Sir If the property has been mutated in the wife's name and no other legal heirs are there then these documents are sufficient for a successful transfer of property. Although it would be suggested to ask the wife to get the will registered and then you proceed with the transfer. Thanks Please rate if you find this advice helpful.

Unregistred will can be challenged however if title is clear and registered relinquish Deed given by all legal heirs in favor of one person ( wife of the original owner) and that person has transferred the property to you. Then that considered a successful transfer and you are eligible for a loan with all original documents.
