I have purchased a flat in Mumbai for 44 lacs and I have paid 40lacs. The agreement is registered and the flat has been sold to me legally and it's under my name. However, there are some pending dues (building maintenance and property tax) by the owner from whom I have purchased the flat which is 2 lacs. Hence I haven't paid the remaining 4 lacs as I'm waiting for him to clear the dues. But it's been almost 3 months and still, he hasn't cleared it. When I told him I'll clear the dues and pay him the remaining funds he said I can't do that as according to the contract there has to be a transaction of 4 lacs that has to be transferred to him in order for the sale to be complete. Now due to this even on the property tax, there's an interest that's getting added for the next year which is unnecessary. Whenever asked when will he clear the due he keeps giving dates. If I pay the dues and keep the receipts, just pay the remaining amount to him can he take any legal action saying I haven't paid full
