Builder had sold the same flat to two different persons one sale agreement he made on 1998 and before construction of property after contrustion he sold same flat to another ..I am the 3rd purchase of the flat and I purchsed this flat from a person wh purchased the said flat from bank in an auction I have all legal documents with me but decree has come with favour of opposite party who purchsed in 1998 stating that I am not a bonafied purchaser and I knew all this fraud still I purchasd this flat which is not true ..our lawyer also not suggest to do fraud case on a person from whom we buy please help me in tis situation what should I do

Firstly take a search of the said property and find how when by whom you have got defrauded and take action . Best advice to visit a lawyer with all the documents for the further guidance.

You can initiate action against Bank w etvhich sold the property in public.auction which was not free from encumbrance s. Mortgage .in favour of Bank. appears to be fraud. Initiate action.against the Bank for refund.of.your money with all.costs.expenses.
