I reside in New Delhi. Planning to buy a Builder Floor which is 3 BHK size 100 Gaz in Delhi, Raj Nagar Extension-II, Palam. The builder has constructed 1 room set in the stilt parking area which is of course unauthorized. I am unaware who are the other buyers of the remaining flat and if any of the other buyers have made any objection or not towards the illegal construction. No matter what, practically, I will not be able to complain or fight for the illegal construction. So my options are either accept as it is and finaliezed the deal or cancel the deal. Based on my needs and budget, this is the best property so i do want to purchase it but at the same time safe guard my interest. For this I have the below questions: 1. Does the builder have the right to allocate a parking area and can I ask for it. 2. What is the best approach for me to ensure I do not have any parking related issue for now or in the future.

hi according to delhi mcd ruless parking shuld be in a buildiing if any unauthorised work done in building mcd can sealed

It is best advised to mention about the parking in your purchase agreement. Also suggest you to check if the property has received a completion certificate. to best safe gurad your self from any future issues

Hello Sir As per the building bylaws, a builder must provide parking space in a housing society but there is no standard rule related to allocation and, often, this becomes a bone of contention among residents. It would be reasonable for your to ask the builder to provide for a parking space otherwise it would be a problem for you in future. Also in present days parking is an important aspect while purchasing the the property. Therefore it would be suggested to First talk with builder regarding the parking then buy the property.
