Your 2 questions is no one can use firm name......if your firm's name register under trade mark and which validity is existing, then no one can use your firm's name.... otherwise any one use....if any else then openly send your questions, shall reply accordingly
First thing, please declare that your Partnership Firm is registered under Registration Act. If your firm registered under the act then send a legal notice to your partner regarding discontinue of partnership and wants to disolve same. If your partner not ready to disolve the firm then file a suit before the registrar or civil court.....
You have to serve a detailed legal notice to the other partner asking for dissolution of the Partnership firm giving the reason which are contrary to the terms as mentioned in the Partnership Deed. If the other partners does not agree for dissolution you have to File a Suit seeking the dissolution of Partnership by order of court. Court will pass an order and the firm will be dissolved. You should enter into an agreement regarding the conditions to be followed by the partners after dissolution and has to be got mutually agreed upon in legal process.
