Vacation Of The Property

Hi, My relatives tenant is vacating the property with some out of the court settlement. But the person who is actually running the business is brother of the tenant(as per agreement). He is only paying us rent for past couple of years. He is suggesting he will only vacate and receive the advance and will sign a paper suggesting he received and vacated on behalf of his brother. Is there any legal issues if we pursue this?
