another solution is to get lock and key possession. payment and possession on same day. for eg loan is of 30lakhs and your agreement value is 1cr. Then pay him 70lakhs and get the entry in home and balance loan to be directly paid to banker. u can have this clause in agreement. Also take his power of attorney to pay the bank and receive original documents. to be more safe get an indemnity bond executed with liquidated damages clause

Bank doesn't release LOD immediately. The best solution is to get thr buyer's loan transferred to you, then the bank will before disbursing your loan will take your agreement in their custody and also the buyer's bank will then not give him the papers but will take control of it. once all is done, you can then pre pay your loan in full and complete the transaction
