Asked in Wills or Trusts
As in this case grandmother is the only person alive and no other relatives are trustworthy she can appoint herself as the guardian of the minor to take care of her and the property till the minor attained the age of majority. It has been observed in many cases that the court award custody to the grandparents under certain circumstances and deny the same in certain circumstances. The court always considers the best of the child. On application by any person, the court may, if it thinks fit, appoint the person to be the guardian of a minor.
Hi, She can get a guardian appointed through the Court if she believes that her own sons cannot be trusted. Alternatively, she can create a trust in the minors' names, so that they are given access to the property when they attain majority and the share will be protected by law until such time. If you found this helpful, please rate us.
In such case she should approach the Guardian Court for appointment of Guardian for the minors either for person and property or only for property as she thinks but should have to take the step cautiously for the purpose.
