Father's Will has following provision about house bequeathed to son: "Son shall endeavour not to sell or gift the Property to any person or company. It will be exclusively utilized by him and his family members. However, in case of need, he can give his part of the Asset on lease or rent if he so desires". Queries : (a) can Son sell or mortgage the Property, (b) can this Property be attached/sold if Son goes bankrupt, and (c) does the response to the preceding (a) and (b) apply to Son's successors also. Property may be assumed to be located in Jaipur, Rajasthan and father is still alive and hence Property will be transferred in the future.

Hello Sir After reading the information provided by you, it would be unreasonable restrictions if father puts a condition that property cannot be sold in future. The transfer of property must complete not with restriction. Although you'll be having all right give the property on rent. After mutating the property in your name, you'll be the sole owner of that property. Better advice could be provided after reading the complete provisions of the will.
