A residential property I am residing in was originally in name of my father. After he passed away, my 3 sisters reliquished the rights on property to me. My brother relinquished his right to my mother. Right now my mother has 1/3rd share and I have 2/3rd share in property. My mother is alive and has made a Will giving the 1/3rd share in property to me after her demise. My question is, If my mother passes away in future and I try to sell the property afterwards, would it create a problem in selling, since I do not have Disclaimer/NOC from my brother and sisters saying they accept this Will of my mother and they won\'t challenge the Will in future.

Dear Sir, Relinquishment Deeds executed by your siblings a sufficient to say that you are the absolute owner of entire property after the death of your mother and you can sell without NOC of your brother and sisters.

Since , did your sister have relinquished their Rights via Relinquishment Deed Registered in that case you have no problem . With Regard to Brother Reliquishing his right mother by Registered Deed is also fine .Ensure your mother makes a Registered Will . Or Entere into a Partition Deed with all your father\'s heirs to avoid Confusion.
