Can I Construct My House On The Land I Am A Partner With Wife Who Is Separated

I have purchased a residential plot in 2020 making myself, my wife and my mother as a partner in the land. In the registration deed nothing is mentioned like which part of the land belongs to whom. Now there is a dispute going on with my file and she has filed a false DV act case against me in the court and she is living at her parents house. I want to ask if it is safe to construct my house on this land or not? I want to mention that all the expenses occurred while purchasing the land, the down payment and the EMI are being taken care of by me only. My wife has not given a single penny. However the bank loan has been disbursed in the name of all three partners (me, my wife and my mother). But i am the only one who is taking care of EMIs. I am living in a rented accommodation, I want to build a house on the land we purchased. Please guide me
