The owner of my apartment is in my name, my mom's name and my brother's name. He is a minor - age 17. The document states that the sale of the apartment cannot be done until he turns 18. However, due to financial needs, we need to sell the property. Is there a workaround of this clause? will it affect the sale of the property and if a NOC letter is given by the other two owners, namely me and my mother..can the apartment be sold?

Dear Sir, Your mother is the natural guardian of her minor son and she can seek permission of the Court or even without such permission yourself and your mother on her behalf and on behalf of her minor son property can be sold for dire family necessities. NO, no-one else can sell the property owned by a minor without the permission of the Court keeping in the Interest and financial benefits of the minor. The guardian has to apply the Guardian Court Under the provisions of Guardian and Wards Act for permission for selling the property belonging to the minor and that too subject to the Conditions imposed by the Guardians Court.
