I am working as Clerk in PNB Bank (PSU) since October 2012 (Joined on 3-October-2012). I didn't took any Maternity Leave till now. I have a 14 years old son (Born on 15-06-2008). Recently on 05-August-2022 I have adopted a new born Girl Child (Born on 31-Jul-2022) from an unknown poor family. After adoption I applied for Maternity Leaves in my Bank Branch, but my application was rejected by providing me a copy of 11th Bipartite Settlement Rules, which describe that only Child-less Female Employee is eligible for Maternity Leaves in case of adoption. But as per many decisions given by Supreme Court of India and Hon'ble High Courts of India, a mother can't be denied to grant of Maternity Leaves upto 2 children. I am seeking legal advice for my case to present in Punjab & Haryana High Court, so the benefit of Maternity Leaves granted to me.

A writ petition may be filed and as an interim measure you may seek relief to maternity leave till final disposal of writ!!! Let's see as how Hon’ble High Court may deal it. Thereafter Supreme Court is also available because this is public importance issue!!! Consult online for better advice!!!
