Sir, you can first resort to claim your wife's due salary by sending a legal notice through an advocate. If the employer still does not pay back the sum due, then there is no other option but to file a case in labour tribunal. Moreover, maternity benefit is a mandate and non payment by employer is illegal. Follow me and give me 5 rating if I was able to satisfy your query
1. salary cannot be deducted for the maternity leave, 2. you can serve him a legal notice through a lawyer to make payment of the salary but it mat bitter the relationship of employer/employee
