I was involved in an accident in a town near Bangalore. Involving a pillion and 2 bystanders. The police has filed a FIR for 279 and 337. To my knowledge the bystanders have not filed a case either and the is 3rd part insurance for the vehicle. But the doctor at the govt hospital has given a document mentioning drunk driving whereas I was not drunk in any way. No alcohol. No tests or anything. I was told that that document would be removed before sending to court by the police. Is there any complication I should be prepared for as there was no blood taken or breathanalyser test done!

you need to move an application immediately to higher authority for re-examine but it's too late now ask your advocate to contest the case strongly

you can contest the case, since no blood test, therefore, you can rebut the presumption of being drunk

If it will be proved in the court that at the time of the accident you were drunk than the insurance company will not be liable to pay any compensation.
