Car And Motorcycle Accident

My family member was driving a car and a motorcycle came from behind and hit the car at a high speed. The motorist is unfortunately under critical condition, but my family member took the guy to the hospital and admitted him to one of the top hospitals in Bangalore and has answered all police and hospital questions. Even though it wasn't my family member's fault, on the document they arrested him and given out on bail/bond. Usually, the bigger vehicle gets blamed irrespective and my family member got stuck in this situation. What are the future implications?
