We are an apartment of about 100 flats. Initially, we had an association, now the association's term has ended and the existing officer bearers don't want to continue. The previous office bearers held several SGMs to conduct the elections but couldn't succeed, all of them want to quit now. There are no flat owners who are willing to come forward and form the association (become office bearers), in such a scenario can the election to office-bearers of the association be held on the basis of Draw of Lots after amending bylaws. And also who is the right authority to approach in such a scenario if the draw of lots is not a possibility- Registrar of Society/Apartment. And what solution would the authority propose.

Sir, First you need to clarify . What kind of Association was formed in your Apartment Complex. if it was formed under Karnataka Apartment Ownership Act. Then you need to approach City Civil and Session Court. In case, If your Association Registered under Societies Act, in such circumstances you have apporach Registrar of Society. Contact me through this Forum for more details. In both cases Court or Registrar Societies will appoint Interim care taker till dispute is resolved.

Hello Sir It would be suggested to First go through the by laws of the society and act according to the by laws. Also if no one is interested then people could call a meeting and discuss what to do in such case. A decision must be taken unanimously by asking everyone there opinion regarding the same.
