Asked in Real estate
Dear Sir, On the basis of clauses mentioned in the agreement such interest may be claimed but not otherwise. Please give me rank after viewing my details. Please call me for further assistance.
Hi, Builder-buyer agreements including sale agreement or property allotment documents usually contain cancellation clauses. Go through the documents in detail as cancellation will be subject to the terms mentioned. Any VAT or service Tax paid will not be refunded in case of a cancellation. Even if no builder-buyer agreement was signed, you are still entitled to cancelling a booking and claiming refund. Normally if the argreement is verbally entered into there is a possibility that there the agreement becomes enforceable and therefore there is a possibility that the builder can levy penalty. However it is advisable that you reach out builder seeking consession. Thank you. Feel free to reach out for advice.
