I live in a gate community of villas. My villa shares a common wall with my neighbor\'s villa. He has recently extended that wall and put a roof on that wall, making the terrace (open area) as another bedroom. He did this in my absence and I got to know only when I returned home. Now there are few issue with that: 1) As per our sale agreement with builder no construction is allowed in villa 2) The common wall is a partition wall and not a load bearing wall. it may not take the load of the roof causing damage to structure 3) They have used full width of common wall, while as per site demarcation half of the common wall is under my plot area. Hence it is also an issue of encroachment. Can you please advise what are the legal recourse I have in this case.

we filed a consumer protection petition against builder and after that file civil suit against neighbor for your right in the building

Mr. Hitesh in gated Community there will be Residential Association , first raise Complain to them and to the Builder , if you woont get relief then file case in Civil Court on basis of Easmentry Right. or Contact any lawyer for relief
