A Sydney-based company called ‘InfoCore’ collects and organises personal data about consumers that is used in the Australian advertising industry. In addition to its data unit, InfoCore has its own advertising service called InfoAd.
The latter business, InfoAd, was traditionally the number two ad service in Australia (by sales revenue) but from January 2018 to February 2021 it lost ground to other advertisers. As of February 2021 it was only the fifth ad supplier (by sales revenue) and still losing business to rivals.
During the same period, from January 2018 to February 2021, other ad services were able to procure standard data packages from InfoCore for a fee of $10,000 per month. In March 2021, InfoCore decided to raise its fee to $40,000 per month. Soon thereafter, several competitors contacted the ACCC to lodge complaints.
What are the possible liability of Infocore.
