  • If there is an arbitration clause in the agreement, it is mandatory for you to invoke arbitration in case the landlord is refusing to release the security deposit. 1st thing which is to be done before invoking arbitration, or even sending a notice is to see whether there are any conditions which have to be followed before initiating arbitration proceedings. If there are any such conditions, for example, the arbitration clause can say that the parties should amicably try to settle the dispute amongst themselves, then this step is mandatory before proceeding further. in case there is no pre-requisite as mentioned above, you can hire a lawyer to issue a notice invoking arbitration and thereafter proceed accordingly.

Here you said owner is not refund you security deposit since last one year, then clear few things : (1) Are you vacant that rented property ? if yes then when ? (2) You have any dues of rent of that house ? (3) Your Agreement is registered in Nibandhon Office ? or Just Notarized ? ( 4) Are you paid rent or deposit through bank account or transition though NetBank ? kindly see all these questions and answers me. After that you need to Send one Legal Notice to your Land Lord for request to return your security deposit amount. but remember the Notice send to Land Lord through your Advocate then only he will back to your deposit amount. for extra query call me between 7 to 9 PM.

First issue a legal notice through lawyer. If still not refunded then next steps will come accordingly. There are many ways to teach a lesson.

Hi, You ought to have issued legal notice to the landlord before vacating the premises. Issue a lawyer's notice now to him expressing your intention to vacate and claim the recovery of the advance deposit. If he refuses to refund the deposit then you may file a lawsuit for recovery along with interest against him. If you find it helpful, please rate my answer. Thank You
