Child Custody

I was abroad. so my husband applied for divorce and in the same case filed an application for custody my 3yr old son in 2018 within 15 days of my travel date and I did file for visa for my son and husband. In the same year, he was given custody of my son and I was given visitation rights. He is allowed to "retain custody of the minor child until further orders". But divorce case is dismissed on ground of no evidence in 2020 Jan. Now I have re-opened the dismissed case and filed an application for custody of my son. But looks like in the court hearing, they mentioned this is not an application for custody of the child since the order passed in 2018 on child custody is still valid even though the case is dismissed. Please advise what should I do to get custody of my 6.5yr old son.
