I separated from my husband.. my kids are with me... I have certain health weakness which needs time to cure.. can I leave my child under husband custody and get back them when I recover under court... my husband wont accept this if I sit and talk with him personally... he is asking to take both kids with him permanently granting me only visitation right.. both are girls aged 2 and 7... I want to know can I get my kids custody. Due to my health issue for few days let the child stay with him.. we are only staying in between 8km radius. He wantedly not accepting joint physical custody. I don't know what to do.. I'm hindu my marriage is registrated in hindu act..

Dear Madam, You can simply leave your children with your husband till you recover. Even if you requires any documentation you can get it execute either before Court or Notary. After your health is recovered you may make some allegations against your husband and get back your children since the children are female your allegations will be considered and Court will order in your favour for custody.

Custody is granted permanently not on temporary basis. But, by mutual consent and on the basis of visitation right your husband can get custody for temporary period, unless he got permanent Custody order.
