Asked in Domestic
Greetings! You have to file the affidavit of assets and liabilities as per the Landmark judgment of Hon'ble Supreme Court of India in the case of Rajnesh vs. Neha. That format has to be followed while preparing the affidavit. For further discussion you may book the consultation.
As per the Domestic Violence Act, the court can order the respondent (husband or his family members) to pay maintenance to the aggrieved person (wife) or to any child of the parties. In the present case, the court has already ordered the payment of interim maintenance to your child, and now it has directed both the parties to file declarations of assets and liabilities. In response to your question, your parents who are above the age of 70 years may not be required to disclose their assets and liabilities unless they have a share in the assets or are dependent on you for their maintenance. However, it is important to note that the court has wide powers to make any order it deems fit in the interest of justice, including the power to order your parents to disclose their assets and liabilities. As your child is already receiving interim maintenance, you are required to disclose your assets and liabilities to the court. The declaration of assets and liabilities is an important document in determining the maintenance amount, and any failure to disclose the assets and liabilities may result in adverse consequences. Therefore, it is advisable that you disclose all your assets and liabilities to the court, as directed, to avoid any adverse consequences. You may also consult with a qualified lawyer who specializes in family law to understand your legal rights and obligations and to help you file the declaration of assets and liabilities in compliance with the court's orders.
Dear client. I am sorry to hear that but in this case you have to disclose all your Assets and liabilities along with your and sister property but what ever property or assets your parent hold in their own capacity that you don't have to furnish legally
Your parents are not legally liable to furnish any of their assets and liabilities. It's only you whose income affidavit is required to be filed before the court just to ascertain whether there is any change in your occupation or income. And the same will also be filed by your wife disclosing her assets and liabilities. And if she's earning 60k then you need not give anything to her as she's capable enough to maintain herself. For more legal assistance I am just a call away.
