Dear Client, You can file a complaint with the police under section 85 and 86 of Bharatiya Nyaya Sanhita (BNS) which deals with cruelty by husband or relatives of the husband and under Protection of Women from Domestic Violence Act 2005. Under Section 125 of the Code of Criminal Procedure (CrPC), you can file for maintenance for yourself and your children. This ensures that you receive financial support from your husband. If the situation is unbearable and you wish to seek a divorce, you can file for divorce on the grounds of cruelty under the Hindu Marriage Act, 1955 or other relevant personal laws applicable to you. You can also approach various NGOs and women shelters for immediate support and counselling. Hire a legal counsel for filing for divorce and other legal remedies. Should you require any further explanation, please do not hesitate to contact us.
