My father and brother in law had taken money from me and my father before my marriage in order to buy a flat. Some amount was given through cheque. Now after my marriage they are harassing me and my husband, as it's a love marriage to give them more money. We didn't agree so they have removed my husband from family business and now filing wrong complaints to throw us out from this house also. I filed case in CAW cell but they dismissed it stating since you are living with your husband it's not a dowry case and dismissed stating it as a property dispute and making it civil in nature. How can we deal with this situation. I have few video evidence also of him abusing threatening also.

Dear client I am sorry for your trouble. in this case you can send him a legal notice demanding your money back and in case he did not respond to that legal notice you can go ahead and file a recovery of money suit before the court under Order 37, of CPC, which permits the lender to bring a summary suit. You can also fill criminal charges against them on the ground of harassment.

Issue them notice through lawyer demanding your money and if they refused to pay then File Money RECOVERY SUIT IN COURT through lawyer.
