Suppose a house is owned by A, B, C, D & E. The will of the house contains name of everyone. But the mutation is still pending and that is why the government portal is not showing the names of the A, B, C, D & E on the portal. Now the house is under bank mortgage and A, B, C have taken the whole possession of the house. Now, what should be the approach of D & E.

Dear Sir, D and E must first see that loan is repaid fully and then try for including their names in the property register.

when you are already entitled to possession file a civil suit for restoration of possession before the civil court or high Court according to the pecuniary jurisdiction of your share value. since your name is the Will you are co-owner of the property as such you are entitled to possession to the extent of your value of share.
