    The Supreme Court recently declared adultery as not an offence. However it is still a ground for divorce in the family court. So in your case your husband can't just go to register a FIR against your BF. He can only file a petition under section 13 for the dissolution of marriage. And if there's no scope of living together then rather than stretching the relationship you should be the first to file for contested divorce.     Adultery is not an offence now in Indian. So your husband cannot take any legal action against that guy but you husband can file divorce case against you. But that depends on evidence he has.
