In 2012 I booked a duplex with a builder and the home is registered in my name. It is 60% completed but the builder despite having taken the complete money has not completed home and given possession. I applied to RERA and judgement was made in my favor to give me 7K INR per month. Now the builder is becoming insolvent and IRP (Insolvency resolution process) and NCLT process have been started. I am being asked to fill the CA form in this regard. My question is that if I was to be given a favorable creditor award of few thousands (based on IRP) - will my property be taken away due to the process of IRP? Should I or Should I not file the creditor claim?
