    There can be two possible ways. Either your partner can himself execute a Will or his brother will be entitled for getting his Estate. But Partnership will cease to exist on death of one partner.     The deceased's estate takes over their share of the partnership. It may be that pursuant to the wishes of the directions of the deceased partner the surviving partner may enter into a new partnership with the heir of the deceased partner, but that would constitute a new partnership.

    Hi, On the death of a partner, the partnership ceases to exist. But the firm may not cease to exist as the other remaining partners may decide to continue the business. In case of death of a partner, the treatment of various items is similar to that at the time of retirement of the partner.
